RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT In consideration of being allowed to participate in the activities and programs of Upper Dublin Sports Center, Tennis Match Academy, The objects, including et al, and to use its facilities and equipment, I do hereby waive, release and forever discharge UDSC LLC et al and its officers, agents, employees, representatives, executors and all others from any and all responsibilities or liability for injuries or damages resulting from my participation in any said activity or my use of any said equipment and machinery. I do also hereby release all of those mentioned as well as any others acting on their behalf from any responsibility or liability for any injury or damage to myself except if said injury or damage is caused by gross negligence on the part of those mentioned.

 

In consideration of the Releases accepting my application for participation at Upper Dublin Sports Center, UDSC,LLC., Tennis Match Academy and The PickleZone and permitting my use of the facilities and premises provided by the Releases, I hereby acknowledge the following: 

 

1. I am aware that I am engaging in physical activity and that the use of Upper Dublin Sports Center, and interaction with any part of the facility, could cause injury to me. 

 

2. I am voluntarily participating in these activities and assume all risks of injury to myself that might result from any of the actions listed below: 

        a. Collision with other persons or objects, including being struck by a racquet, paddle or ball 

        b. The risk of stroke, heart attack, or other similar life-threatening conditions caused by physical exertion leading to loss of balance or control, slips, trips, and falls 

        c. The risk of personal injury, including but not limited to strains, sprains, fractures, brain injury, spinal cord injury (including paraplegia or quadriplegia), or death 

        d. Negligent first aid performed by other parties or medical professionals 

        e. Failure to act safely or within one's own ability as well as the negligence of other participants 

 

3. I agree to waive any claims or rights I might otherwise have to sue UDSC, its owners, officers, or employees for injury to me as a result of these activities, except if such injury or damage is caused by the gross negligence of the Releases. 

 

4. I have carefully read this waiver, which states that I assume all risks of injury. I am hereby advised that I should be sufficiently physically fit for exercise activities and participation in events at the Upper Dublin Sports Center.

 

5. I understand that I should have consulted a physician prior to undertaking any physical exercise. If I am signing on behalf of a minor, I acknowledge that my child or dependent 

 

6. To wear court shoes designed for tennis or pickleball and adhere to all rules of the sport. 

 

7. UDSC reserves the right to revoke a participant's membership or playing privileges for misconduct, including but not limited to bullying, cheating, using inappropriate language, intimidating or harassing others, and loss of temper. 

 

8. UDSC has the right to use and publish photographs or videos of me participating in any of the activities at the club, or in which I may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without my inspection or approval. I waive any right to compensation arising from or related to the use of such photographs or videos. 

 

9. The undersigned participant (or parent/legal guardian of the participant, if participant is a minor), hereby authorizes the sports club, its representatives, agents, employees, and volunteers to obtain medical treatment for myself/my child in the event of an emergency where immediate medical attention is deemed necessary. This authorization extends to any necessary medical examinations, treatments, diagnostic tests, surgical procedures, or other medical interventions deemed appropriate by qualified medical personnel. I understand that efforts will be made to contact me/my emergency contact prior to initiating any medical treatment, but in the event that I/my emergency contact cannot be reached in a timely manner, I authorize the sports club and its representatives to proceed with necessary medical treatment. I also agree to be responsible for any and all costs associated with such medical treatment. 

 

SPECIAL COVID-19 ADDITION I acknowledge that I have seen and read the information provided by UDSC, LLC., on club procedures during COVID-19. I further understand that my failure to report my personal illness can lead to further infections, and the club has the right to restrict or deny my access to the facility. 

 

PLEASE READ CAREFULLY BY SIGNING THIS DOCUMENT, YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT 

 

This Release Agreement shall apply to all participants and subsequent Membership, Programs, Lessons and Seasonal Court Time renewals. 

 

RELEASE: The Upper Dublin Sports Center, and its respective directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, and assigns (hereinafter collectively referred to as the "Releases"). 

 

CERTIFICATIONS: I have read and understand the foregoing waiver. I am aware that this waiver releases Upper Dublin Sports Center and contains an acknowledgement of my voluntary and knowing assumption of the risk of property damage or loss and/or injury or illness (minimal, serious, catastrophic, and/or death), except if such injury or damage is caused by the gross negligence of the Releases. I have signed this document voluntarily and of my own free will.
